Mortgage Lender Has No Say in Your Homeowners Insurance Limit
Question: Can a lender demand that a home buyer purchase a specified amount of insurance, or purchase a policy from a specified lender?
Answer: While lenders are free to insist that sufficient insurance is purchased to protect the lender's financial interest, they may not require customers, as a condition of the loan, to purchase insurance from any particular insurer. Provisions in the California Civil Code prohibit lenders from requiring insurance in excess of the replacement value of whatever building or other improvements are on the land.
New Sticker Helps Drivers Shopping for a Green Machine
Once again, California is leading the way in environmental efforts, instituting a green performance label for every new car sold in the state. Currently voluntary, the so-called "environmental performance" rating sticker will become a requirement starting January 1, 2009. According to Edmunds' Green Car Advisor, new car dealers will be mandated to attach eco labels, such as the one pictured above, to all '09 model year vehicles. Each car's greenhouse gas impact will be rated "on a 1-10 scale, with the highest scores representing the least impact, so a ‘9' will be greener than a ‘7'." California Air Resources Board Chairwoman Mary Nichols said the new state law was created to "arm consumers with the information they need to choose a vehicle that saves gas, reduces greenhouse gas emissions and helps fight smog."
